Product Liability

Product liability claims intend to compensate for injury caused by the defective merchandise of a manufacturer or vendor. Product liability claims typically fall into one of the following three categories: (1) negligence, (2) strict product liability, and (3) breach of warranty. To have a successful product liability claim, the plaintiff (the person suing) must prove that the product was defective, that the plaintiff was harmed by or because of the defective product, that the plaintiff sustained an actual injury due to the defective product, and that the manufacturer or vendor owed the plaintiff a duty to make or sell a safe product.
